If you live in the United States, you and The Local Social agree to resolve disputes through binding individual arbitration, unless the dispute qualifies for small claims court.

a) Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product/service (“Dispute”) will be resolved by confidential binding arbitration on an individual basis.

b) No Class Actions

You agree that disputes will be brought only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

c) Arbitration Location

Unless otherwise required by law, arbitration will take place in Virginia, or may be conducted remotely (video/phone) when appropriate.

d) Exceptions

Either party may seek injunctive or equitable relief in court for claims involving intellectual property misuse (e.g., copying, reselling, redistribution, trademark infringement).

e) Arbitration Rules

Arbitration will be administered by a recognized arbitration provider and conducted under its applicable rules in effect at the time the arbitration is initiated.

20) TIME LIMIT TO BRING CLAIMS

To the extent permitted by law, any claim or cause of action must be brought within one (1) year after the claim arises, or it will be permanently barred.

21) SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in effect.

22) ENTIRE AGREEMENT
